1. Agreement to these Terms

These Terms and Conditions ("Terms") govern your access to and use of MilCareer Xplorer at milcareerxplorer.com and any related pages, tools, and features (collectively, the "Site").

The Site is owned and operated by Fountainhead Development & Construction LLC ("Company," "we," "us," "our").

The Site is an independent, privately operated informational resource. It is not affiliated with, endorsed by, sponsored by, or officially connected to the United States Government, the Department of Defense, the Department of Homeland Security, or any branch, component, or agency of the United States Armed Forces. The Company is not a recruiter and has no authority to enlist, commission, or make any commitment to any person.

By accessing or using the Site, you agree to be bound by these Terms and by our Disclaimer, which is incorporated into these Terms by reference. If you do not agree, do not use the Site.

2. Eligibility and minors

The Site is intended for a general audience researching military career options. It is not directed to children under 13, and we do not knowingly collect personal information from them.

If you are under 18, you may use the Site only with the knowledge and involvement of a parent or legal guardian, and you should review the Disclaimer together with them — particularly the section describing the risk of serious injury and death in military service. Decisions about military service made by a minor require parental or guardian consent under applicable law and the policies of the Armed Forces.

If you are a parent or legal guardian and you permit a minor in your care to use the Site, you agree to these Terms on your own behalf and on behalf of that minor, you acknowledge that you have read Section 4 of the Disclaimer describing the risk of serious injury and death in military service, and you agree that Section 7 of these Terms applies to you and to any claim you may bring individually or on that minor's behalf.

If applicable law does not permit a parent or legal guardian to release, waive, or limit claims belonging to a minor, then Section 7 shall nonetheless remain fully effective as to all claims belonging to the parent or legal guardian individually, and as to the minor's own claims once the minor reaches the age of majority and continues to use the Site.

3. Permitted use

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial, informational purposes.

You agree not to:

use the Site for any unlawful purpose or in violation of these Terms;
scrape, harvest, crawl, or systematically extract content except as a well-behaved search engine crawler honoring our robots.txt;
copy, reproduce, republish, sell, license, or redistribute Site content without our prior written permission;
misrepresent the Site, or any content on it, as official military or government material;
present yourself as affiliated with the Company or the Site;
attempt to gain unauthorized access to the Site, its servers, or related systems, or interfere with their operation or security;
introduce malware, or use automated means to overload or impair the Site.

4. Intellectual property

Except for content in the public domain or owned by third parties, the Site and its original content, compilation, organization, text, design, and code are the property of the Company and are protected by copyright and other laws.

Military occupational specialty codes, job titles, branch names, and similar designations are used descriptively. Trademarks, service marks, and insignia appearing on the Site are the property of their respective owners, and their use does not indicate endorsement or affiliation.

5. No professional relationship

Your use of the Site does not create any advisory, fiduciary, counseling, or professional relationship between you and the Company. Content is general information and is not legal, financial, medical, psychological, educational, or professional career counseling advice.

6. Disclaimer of warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, THE COMPANY DOES NOT WARRANT THAT THE SITE OR ITS CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE, THAT THE SITE WILL BE AVAILABLE OR UNINTERRUPTED, OR THAT ANY INFORMATION ABOUT MILITARY OCCUPATIONAL SPECIALTIES, PAY, BONUSES, REQUIREMENTS, BENEFITS, TRAINING, ASSIGNMENTS, DUTIES, RISKS, OR CIVILIAN CAREER OUTCOMES IS ACCURATE OR APPLICABLE TO YOU.

7. Assumption of risk and release regarding military service

You acknowledge and agree that:

(a) Military service is inherently dangerous and carries a risk of serious bodily injury, permanent disability, psychological injury, illness, and death. This risk exists in every branch, every component, and every occupational specialty, including any role described anywhere on the Site as non-combat, support, administrative, technical, medical, logistics, maintenance, or any similar term.

(b) Descriptions of occupational specialties on the Site are general descriptions of typical duties. They are not predictions, assurances, or guarantees regarding deployment, assignment, duty station, actual duties, exposure to hostile action or hazardous conditions, or personal safety. Service members in any specialty may be deployed to combat zones or hostile environments, assigned duties outside their specialty, and injured or killed.

(c) All decisions regarding assignment, deployment, duties, and training are made solely by the United States Armed Forces and are entirely outside the Company's knowledge, control, or influence.

(d) The Site is not a solicitation or invitation to enlist. No content on the Site is intended or designed to persuade, induce, or encourage any person to join any branch of service, to select any occupational specialty, or to sign any enlistment, commissioning, or service contract.

(e) You covenant that you will not rely on the Site in deciding whether to enlist, commission, select an occupational specialty, or sign any contract, and that before making any such decision you will independently verify all relevant information with an official recruiter and official government publications, and will consult your family, your advisors, and, if you are a minor, your parent or legal guardian. Any decision you make regarding military service is your own independent decision, not one made in reliance on the Site.

(f) ASSUMPTION OF RISK AND RELEASE. PLEASE READ THIS SUBSECTION CAREFULLY. IT LIMITS YOUR LEGAL RIGHTS AND RELEASES THE COMPANY FROM LIABILITY, INCLUDING LIABILITY FOR THE COMPANY'S OWN NEGLIGENCE.

YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH ANY DECISION TO PURSUE MILITARY SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE FOUNTAINHEAD DEVELOPMENT & CONSTRUCTION LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, CAUSES OF ACTION, LIABILITIES, LOSSES, COSTS, AND EXPENSES OF ANY KIND — INCLUDING CLAIMS ARISING IN WHOLE OR IN PART FROM THE RELEASED PARTIES' OWN NEGLIGENCE — AND INCLUDING CLAIMS FOR PERSONAL INJURY, ILLNESS, DISABILITY, EMOTIONAL DISTRESS, WRONGFUL DEATH, LOSS OF CONSORTIUM, AND SURVIVAL OR WRONGFUL-DEATH CLAIMS BROUGHT BY YOUR HEIRS, EXECUTORS, ADMINISTRATORS, ESTATE, FAMILY MEMBERS, OR PERSONAL REPRESENTATIVES — ARISING OUT OF OR RELATING IN ANY WAY TO MILITARY SERVICE, ENLISTMENT, COMMISSIONING, TRAINING, ASSIGNMENT, DEPLOYMENT, OR ANY INJURY, ILLNESS, DISABILITY, OR DEATH OCCURRING IN CONNECTION WITH MILITARY SERVICE, WHETHER OR NOT CONNECTED TO INFORMATION OBTAINED FROM THE SITE.

You further agree that neither you nor anyone claiming by or through you will assert that the Site caused or contributed to any decision to serve.

(g) What this release does not cover. Nothing in this Section 7 is intended to, and nothing shall be construed to, release, waive, limit, or exclude liability for gross negligence, recklessness, willful or intentional misconduct, fraud, or any other liability that may not lawfully be released, waived, limited, or excluded under applicable law.

(h) Interpretation and survival. This Section 7 is intended to be enforced to the fullest extent permitted by the law of the State of Texas. If any part of it is held overbroad, invalid, or unenforceable, that part shall be narrowed, reformed, or severed to the minimum extent necessary so that the remainder is given full effect, and the remaining provisions shall continue in full force. This Section 7 survives your discontinuation of use of the Site, any termination of these Terms, and any subsequent decision by you to enlist, commission, or serve, and continues to apply for so long as any claim covered by it could be brought.

(i) If you are outside Texas. The Site is operated from the State of Texas and is directed to a general United States audience. If you access the Site from outside Texas, you do so on your own initiative and are responsible for compliance with the laws of your own jurisdiction. You agree that this Section 7 applies to you. Nothing in this Section 7, however, is intended to deprive you of the protection of any provision of the law of your home jurisdiction that applies to you and that cannot be waived or limited by agreement; to the extent any such provision applies, this Section 7 is enforced to the greatest extent it lawfully may be, and the remainder continues in effect.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, DISABILITY, EMOTIONAL DISTRESS, DEATH, LOSS OF INCOME, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT ON IT, OR TO ANY DECISION YOU MAKE REGARDING MILITARY SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, STATUTE, OR ANY OTHER THEORY, AND EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00) OR THE AMOUNT YOU PAID THE COMPANY IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Nothing in this Section 8 limits or excludes liability for gross negligence, recklessness, willful or intentional misconduct, fraud, or any other liability that may not lawfully be limited or excluded under applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, the Company's liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, your violation of any right of a third party, or any decision you make regarding military service.

10. Third-party sites, recruiters, and content

The Site may contain links to third-party websites, recruiting resources, government pages, maps, and other materials. The Company does not control and is not responsible for their content, accuracy, availability, security, or privacy practices, and a link does not constitute endorsement.

Any interaction between you and a recruiter, recruiting office, branch of service, school, employer, or other third party is solely between you and that party. The Company is not a participant in, and assumes no responsibility for, any such interaction or its consequences.

11. Privacy

Your use of the Site is also governed by our Privacy Policy.

12. Changes to the Site and to these Terms

We may modify, suspend, or discontinue the Site or any part of it at any time without notice. We may also revise these Terms at any time by posting an updated version with a new "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Review them periodically.

13. Termination

We may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice. Sections 4 through 9 and 14 through 17 survive any termination, as further provided in Section 7(h).

14. Governing law and venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, without regard to its conflict of laws principles.

You agree that any action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction and venue of those courts and waive any objection based on improper venue or inconvenient forum.

The Company makes no representation that the Site or its content is appropriate or available for use outside the United States. If you use the Site from outside Texas or outside the United States, you do so on your own initiative and are responsible for compliance with local law. This Section does not deprive a consumer of the benefit of any mandatory protection of the law of their place of residence that cannot be derogated from by agreement.

15. Severability, waiver, and assignment

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions shall remain in full force and effect.

No failure or delay by the Company in exercising any right constitutes a waiver. You may not assign these Terms without our written consent; we may assign them freely.

16. Entire agreement

These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and the Company regarding the Site, and supersede any prior understandings.
